Welcome to Boundary X. These Terms & Conditions apply to your use of our website, purchase of our products, and use of our services. By accessing our website or placing an order with Boundary X, you agree to these Terms & Conditions.
1. About Boundary X
Boundary X supplies cricket equipment, apparel and related products, including cricket bats, batting gloves, pads, protective equipment, wicketkeeping equipment, cricket balls, training equipment and customised products.
2. Products
We aim to ensure all product descriptions, images, specifications and prices are accurate. However, colours, grain structure, markings and appearance may vary slightly from photographs, particularly for handmade and natural-material products such as English Willow cricket bats.
Each cricket bat is unique. Grain count, weight distribution, profile, handle feel, willow appearance and performance characteristics may vary between bats.
3. Pricing
All prices displayed on our website are in Australian Dollars (AUD) unless otherwise stated.
Boundary X reserves the right to change product prices at any time. Any price change will not affect an order that has already been accepted and paid for.
Shipping and other applicable charges will be displayed during checkout where applicable.
4. Orders
By placing an order, you confirm that the information you provide is accurate and that you are authorised to use the selected payment method.
Boundary X reserves the right to refuse or cancel an order where:
- A product is unavailable;
- An incorrect price or product information has been displayed;
- Payment cannot be processed;
- Fraudulent or suspicious activity is suspected; or
- We are otherwise unable to fulfil the order.
If payment has already been received for an order we cannot fulfil, the applicable amount will be refunded.
5. Custom Cricket Bats & Personalised Products
Custom cricket bats, personalised products, laser engraving and products made or modified specifically for a customer may require additional production time.
Customers are responsible for checking all names, initials, spelling, sizing and customisation instructions before approving an order.
Once work has commenced on a customised or personalised product, changes or cancellations may not be possible.
Custom or personalised products generally cannot be returned for a change of mind unless the product is faulty, damaged, incorrectly supplied or otherwise covered by rights available under Australian Consumer Law.
6. Cricket Bat Specifications
Requested bat weights, profiles, edge sizes, toe sizes, middle positions and other measurements are target specifications.
Because cricket bats are manufactured from natural timber and may involve handmade finishing, minor variations can occur.
Final weight may also change depending on grips, stickers, protective facing, toe protection and moisture content.
7. Bat Preparation, Knocking-In & Use
Where applicable, cricket bats may require knocking-in and preparation before match use.
Unless Boundary X specifically confirms that a bat is fully prepared for immediate match use, the customer is responsible for ensuring the bat is properly prepared.
Cricket bats may suffer damage from normal use, including surface cracks, seam marks, edge damage and toe damage. Normal wear and tear does not automatically mean that a bat is faulty.
We recommend appropriate care, including avoiding excessive moisture, storing bats correctly and using suitable protection where appropriate.
8. Payment & Deposits
Orders must be paid using the payment methods made available by Boundary X.
Where a deposit is accepted for a custom product or special order, the deposit secures the order and allows work or product allocation to begin.
Any remaining balance must be paid by the agreed due date.
Where work has already commenced or stock has specifically been secured for the customer, deposits may not be refundable for a change of mind, subject to Australian Consumer Law.
9. Shipping & Delivery
Boundary X primarily uses Australia Post and may use other delivery providers where required.
Delivery estimates are estimates only. Boundary X is not responsible for delays outside our reasonable control once an order has been transferred to the delivery provider.
Customers are responsible for providing an accurate delivery address.
If an incorrect or incomplete address is supplied and the parcel is returned, additional postage charges may apply before the order is resent.
Risk in the goods passes in accordance with applicable Australian law.
10. International Orders
International customers are responsible for ensuring products can legally be imported into their country.
International orders may be subject to customs duties, taxes, import fees or other government charges. Unless otherwise stated, these costs are the customer’s responsibility.
Boundary X is not responsible for delays caused by customs authorities or international delivery networks.
11. Returns, Refunds & Consumer Guarantees
Our products come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any consumer rights that cannot legally be excluded.
If you believe a product is faulty, damaged or incorrectly supplied, please contact Boundary X as soon as possible and provide your order details and, where requested, photographs or other information relating to the issue.
Change-of-mind returns may be subject to our separate Refund & Returns Policy.
12. Wear, Damage & Misuse
Boundary X is not responsible for damage resulting from:
- Normal wear and tear;
- Incorrect knocking-in or preparation;
- Misuse or unreasonable use;
- Poor storage;
- Excessive moisture or heat;
- Deliberate damage;
- Unauthorised repairs or alterations;
- Using equipment for a purpose it was not designed for; or
- Failure to follow reasonable care instructions.
This section does not limit rights available under Australian Consumer Law.
13. Product Availability
All products are subject to availability.
Where an item becomes unavailable after an order has been placed, we may offer a replacement, provide an estimated availability date or issue an appropriate refund.
14. Promotions & Discount Codes
Promotions, giveaways, discount codes and special offers may be subject to separate conditions.
Boundary X may modify or withdraw a promotion where reasonably necessary, subject to any legal obligations.
Unless otherwise stated, discount codes cannot be combined with other offers.
15. Intellectual Property
All Boundary X branding, logos, product designs, photographs, website content, graphics and other original material remain the property of Boundary X or the relevant rights holder.
Content may not be copied, reproduced, modified, distributed or commercially used without prior permission.
16. Website Use
You must not use our website:
- For unlawful purposes;
- To interfere with the operation or security of the website;
- To attempt unauthorised access to systems or information;
- To distribute malicious software; or
- In a way that infringes the rights of Boundary X or another person.
17. Third-Party Services
Our website may use third-party services including payment processors, delivery providers and website platforms.
Boundary X is not responsible for third-party websites or services outside our reasonable control.
18. Limitation of Liability
To the maximum extent permitted by law, Boundary X will not be liable for indirect or consequential losses arising from the use of our products or website.
Nothing in these Terms & Conditions excludes or limits liability where doing so would be prohibited under Australian Consumer Law or other applicable law.
19. Privacy
Personal information collected through Boundary X is handled in accordance with our Privacy Policy and applicable privacy laws.
20. Changes to These Terms
Boundary X may update these Terms & Conditions from time to time.
Any changes will apply from the date the updated Terms & Conditions are published on our website.
21. Governing Law
These Terms & Conditions are governed by the laws of Victoria, Australia.
Any dispute will be subject to the jurisdiction of the courts and tribunals of Victoria and any applicable Commonwealth jurisdiction.
